To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
During registration, the Service may retrieve publicly available information from SAM.gov and other government databases based on your UEI or company name. You are responsible for confirming the accuracy of this information.

The Service provides pricing benchmarks and competitive intelligence based on aggregated market data. This information is provided for informational purposes only and does not constitute a recommendation or guarantee regarding bid pricing, win probability, or contract award. You are solely responsible for your pricing decisions and bid submissions.
The Service may prepare quote packages and facilitate submission to government procurement portals. However:
The Service includes compliance checklists and flags (such as Buy American, TAA, and warranty requirements) as a convenience feature. These are informational aids, not legal advice. The Service, including its design, algorithms, pricing models, software, and documentation, is owned by BidFlow and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
We do not warrant the accuracy, completeness, or reliability of pricing intelligence, match recommendations, compliance checklists, or any other information provided through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIDFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, CONTRACTS, OR DATA, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless BidFlow and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
Either party may terminate these Terms at any time. You may cancel your subscription through your account settings or by contacting us. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason with reasonable notice.
Upon termination, your right to use the Service ceases immediately. We will retain Your Data for 90 days following termination to allow for export, after which it will be deleted or anonymized.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Virginia.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
